Abstract

The International Court of Justice issued a historic advisory opinion confirming that the right of workers and their organizations to strike is protected by the ILO Freedom of Association and Protection of the Right to Organise Convention, 1948 (No. 87). The dispute stemmed from the position taken by employer representatives, who questioned the long-standing approach of ILO supervisory bodies regarding the Convention's protection of this right. Yulia Ostrovskaya, a researcher at the Institute of Sociology of the Federal Center of Theoretical and Applied Sociology of the Russian Academy of Sciences (IS FCTAS RAS), explained how this long-standing disagreement was resolved.
