Abstract

The purpose of the work is to identify and understand the risks associated with boosting the digital transformation of the state control area. The authors considered various aspects of the problem related to the progressive increase in the load on objects of control (citizens, organizations, different sectors of the economy, including science) due to large-scale involvement in the delivery and verification of primary data, the re-evaluation of the infallibility of Artificial Intelligence systems, the use of Agile approaches in the development of digital solutions (in fact, systems are implemented in an experimental mode using citizens as the test subjects), etc. The authors paid special attention to the risks that arise from the fact that the law is objectively late in digital control's understanding and creating effective regulation of this area. Today, there has been a significant change in using the law as a part of the technological chain for digital transformation stimulation. In fact, in the context of institutional design, which the state uses widely in advance mode, the law does not regulate but legalizes new practices, finding legal meaning and justification for decisions that formally may contradict existing legal principles and norms.
