Abstract

Background & objective: The article is concerned with the conceptualization of legal protection of entrepreneurs within the theory of property rights based on previous studies conducted by D. Gould, W. Gruben, M. Thompson, F. Rushing and others. Several cases related to trademarks that exist in Russia since the Soviet time are selected as a specific example of the theory development. Methodology: The author used traditional analysis of documents, analysis of the media field using «Integrum» database, and secondary analysis of the data obtained by research agencies. Results: The main result of the analysis is that Soviet trademarks can serve as a factor of chronic economic inefficiency that implies the implementation of special measures to reduce risks for entrepreneurs. Conclusion: The consequent application of the findings obtained in the article lies in the field of both law enforcement practice and sociological expertise in intellectual property and trademarks protection. It seems necessary to develop legislative measures to optimize of entrepreneurs' rights protection connected with trademarks, including those registered in the Soviet period.
